MyMithra by Samasra Soft Private Limited (“MyMithra”, “we”, “us”, “our”) operates as a unified wellness and healthcare aggregator platform in India.

MyMithra by Samasra Soft Private Limited is a technology platform connecting users with partner facilities. We are not directly a hospital, medical clinic, physiotherapy centre, rehabilitation facility, pharmacy, insurance provider, or licensed healthcare provider ourselves.

The platform:

• Provides access to third-party fitness facilities, equipment, group classes, clinics, and wellness-related services
• Offers general health and wellness guidance and lifestyle support
• Connects users with independent practitioners, trainers, instructors, or third-party medical/wellness professionals
• Uses digital systems for booking, membership management, scheduling, communication, and record-keeping

3. No Liability for Health Outcomes

To the maximum extent permitted under the laws of India, MyMithra by Samasra Soft Private Limited shall not be liable for:

• Injury, illness, or adverse health outcomes arising from participation in activities, classes, or sessions booked through the platform
• Decisions made by users based on guidance, assessments, or recommendations on the platform
• The actions, advice, or services of independent providers, clinics or third-party professionals
• Delays in seeking medical treatment
• Failure by users to disclose relevant medical conditions or health information to their chosen providers
• Any reliance placed on information provided through our website, digital systems, communications, or printed materials

Participation in physical exercise and medical treatments carries inherent risks. Users acknowledge that they engage in all activities voluntarily and at their own risk.

MyMithra does not guarantee:

• Specific health, wellness, or performance results
• That any programme or provider will be completely suitable for every individual
• The completeness or medical accuracy of general health-related information provided on the platform

4. User Responsibilities

By registering on MyMithra, you agree that:

• You are responsible for ensuring that all personal information, contact details, and health declarations you provide are accurate, complete, and kept up to date
• You will inform the respective partner providers of any relevant medical conditions, injuries, or physical limitations before participating in activities or treatments
• You will consult a qualified and registered medical professional before beginning any new health programme, particularly if you have pre-existing health conditions
• You understand that our platform connects you with professionals, but the platform itself is not a substitute for professional medical advice, diagnosis, or treatment
• You acknowledge that digital systems, booking platforms, and communication tools may occasionally experience technical errors, service interruptions, or delays

5. Limitation of Liability

To the fullest extent permitted by the laws of India, MyMithra by Samasra Soft Private Limited shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive loss or damage
• Loss of profits, revenue, business opportunity, goodwill, or anticipated savings
• Loss, corruption, or unauthorised access to data
• Service interruptions, system outages, cyber incidents, or failures of third-party service providers
• Any loss arising from events outside our reasonable control

Our total aggregate liability to you for any claim arising out of or in connection with your usage, use of our facilities, or use of our digital systems shall be limited to:

• The total transaction fees paid by you to MyMithra in the 12 months preceding the event giving rise to the claim.

• Partner clinics, gyms, salons, and wellness centers

MyMithra:

• Does not own or control third-party partner facilities
• Is not responsible for the acts, omissions, policies, or regulatory compliance of independent third parties and partner clinics
• Does not guarantee the availability, performance, or security of third-party systems

Your use of MyMithra services, website, and digital systems is subject to our Privacy Policy.

Personal data is processed in accordance with applicable Indian data protection legislation, including the Digital Personal Data Protection Act (DPDP Act) and the Information Technology Act 2000.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

You and MyMithra by Samasra Soft Private Limited agree that the courts of Tirupati, Andhra Pradesh, India shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, your usage, or use of our services.
